X Global Privacy Policy

This privacy policy (“Privacy Policy”) applies to the Giftloop mobile application (the “Service”) operated by X Global LLC (the “Company”). The Privacy Policy applies to the Service and to all of the features, mobile applications, emails, online services and other functionalities (collectively, the “Features”) available via or related to the Company, whether accessed via a computer, mobile device, or otherwise (collectively, the “Service and Features”). This Privacy Policy only covers information collected by the Company through the Services and Features, and does not cover any information received or collected offline by the Company or collected by any unrelated websites or companies to which the Company may provide links.

Your access to and use of the Service and Features is conditioned on your accept ance of and compliance with this Privacy Policy. This Privacy Policy applies to all visitors, users and others who access or use (collectively, the “Members”) the Service and Features.

This Privacy Policy is a legal agreement between Members and the Company. By accessing or using the Service and Features, and/or clicking to “Accept” Members agree to be bound by this Privacy Policy as well as our Terms of Use. If you disagree with any part of this Privacy Policy do not register or access the Service and/or the Features.

Personal Information

When using the Service and Features, Members may be required to share information that identifies them personally. “Personal Information” refers to any information that can reasonable be used to identify, contact or locate Members. Personal Information may include, without limitation, first and last name, location, credit card number, email address, mailing addressee, and phone number.

The Company may collect Personal Information when Members’ provide it by using the Service and Features. This may include registering for an account, filling out surveys, joining a mailing list, correspondence between Members’ and the Company, submitting testimonials, or Members’ otherwise volunteering or providing Personal Information.

The Company may use Members’ Personal Information and other information that is collected about Members’ in order to provide and/or improve the Service and Features. This information can be used, without limitation, for advertising, content, surveys, offers, promotions, rewards, and for other marketing, administrative and general business purposes.

Other User Information

The Company may also collect other information from Members’ that is not classified as Personal Information. This information may include, without limitation, Members’ IP address, device ID, referrer data, browser information, platform type, mobile operating system, device sensor information, availability of payment enabled wallets, mobile device unique device identifier (UDID), and information about the way the Member uses the mobile application. Members’ do not have to register to the Service and Features before the Company can collect this information. The Company may assign Members a user ID number and link additional data to that user ID number, including, without limitation, to data and time of visits, the information Member provides, and links that Member choose to click. The Company may analyze and use this information for business purposes including, without limitation, to operating and improving the Service and Features, collecting further information about and learning from user behavior and trends, and gathering demographic information. The Company may also use GPS or similar geolocation technology to determine the city and/or geo-coordinates of where you are located.

Information from Third Parties

The Company may also receive and supplement the information directly collected from Members with information from third parties. If a Member opts-in to on any third party website or service, the third party service may forward the Company collected information.

Third Party Links

The Service and Features may contain links to third party websites and services that the Company does not own. The third party services may collect information based on Members interaction with those offers for goods, services, and the like. This Privacy Policy does not cover third party privacy practices and the Company is not responsible for the privacy practices of any third party.

Advertising Networks

The Company may allow third party ad servers or advertising networks to display advertisements on the Service and Features. These advertisements may be based on Members’ interests as reflected in their use of the Service and Features as well as use of other websites and services. Some of these ad networks may track user behavior, using various technologies, in order to serve more relevant advertisements to Members. Each third party company has its own privacy policy that may differ from this Privacy Policy.

The Company may share your Personal Information and other information with advertisers, merchants, survey partners, and others for the purpose of making it easier for Members’ to sign up for offers, promotions, surveys, authenticating and/or validating Members’ identification, crediting Members’ with earned rewards, and other business practices. The Company may share information with service providers and other third parties to assist in delivering content, advertising, surveys, offers, rewards to Members, administrative, and general business purposes.

Geographic Location Information

For users in North America, our apps may share your device’s precise geolocation and other details about your device (like hardware characteristics, a variety of sensor data, and a list of installed third-party applications) with our partner Sense360 on an ongoing basis, including when the apps are closed. This information is sent with the device’s advertising identifier or another unique device-specific code. Sense360 may use all of this information for market research and other research regarding aggregated patterns, and as further described in its Privacy Policy, which has more detail on the entire process. For example, Sense360 analyzes restaurant visit trends to better serve its customers’ needs. You can use your device settings to (i) disable or limit precise geolocation collection for the entire device (which will affect some device functionality) or just particular apps (which may affect the functionality of this app) and/or (ii) disable or limit use of the advertising identifier (which will block that identifier’s transmission to Sense360).

Children’s Policy

The Service and Features are intended for a general audience and the Company does not knowingly collect any Personal Information from children younger than thirteen (13). If a Member is under eighteen (18), they should use the Service and Features only with involvement of a parent or guardian. If a member is under 13, they should not submit any Personal Information to the Company. If the Company learns that it has inadvertently collected Personal Information from a child younger than 13, we will take reasonable efforts to delete such Personal Information from our databases. 

Security

The Company maintains security measures in order to attempt to protect against loss, misuse, and altercation of Personal Information under its control. The Internet and other various networking communication media are not entirely secure and therefore Members information is subject to interception or loss, which is beyond the Company’s reasonable control. The Company will always attempt to protect Personal Information, however the Company can not ensure or warrant the security of any Personal Information that has been transmitted from Members and transmission is done at Members own risk. The Company assumes no responsibility or liability for disclosure of Members’ Personal Information or other information due to errors in transmission, unauthorized third party access or other causes beyond the Company’s reasonable control. 

Law

The user data is generally maintained in the United States, it is possible that companies or individuals contracted by the Company may process some of the data outside the United States. Data protection laws in other countries may vary and the Company will make reasonable effort to protect Members’ Personal Information. By using the Service and Features Members consent to the transfer of personal data to any server used by the Company or its service providers. If Member is not a resident of the United States you are consenting to the transfer, processing, storage, and use of Personal Information in the United States. The interpretation and application of this Privacy policy shall be governed by the laws of the United Stats and the State of California without regard to its conflict of law provisions. Members’ use of the Service and Features are not intended to subject the Company to the laws or jurisdictions of any state, country, or territory other than that of the United States. 

California Privacy (California Residents Only)

California residents have the right under California Civil Code Section 1798.83 to request certain disclosures when they provide personal information to a business, if that business shares that personal information with third parties. Once per calendar year California residents may request that the Company provide a list of third party companies with which it shares such personal information. 

Changes

The Company reserves the right, at our sole discretion, to modify or replace this Privacy Policy at any time. If a revision is material we will try to provide at least 5 days' notice prior to any changes to this Privacy Policy taking effect. What constitutes a material change will be determined at the Company’s sole discretion.
